Washington State Judge Nixes Capital Gains Tax

Voters in Washington state are as progressive as they come (thanks to Seattle lunacy) but the one thing that keeps the state prosperous is that there is no state income tax.

Last June, Washington State’s liberal legislature thought they’d found an escape clause when they passed a 7 percent long-term capital gains tax.  They claimed the tax was really an excise tax not an income tax.

Douglas County Judge Brian Huber threw that absurd theory out the window and ruled that the only way to impose this backdoor income tax was with a Constitutional amendment.

That isn’t likely to happen because last November, voters in 38 out of 39 Washington counties opposed the new capital gains tax.
